1. General provisions – Application of the general terms and conditions of sale
1.1 These general terms and conditions of sale are applicable to orders placed on the website www.canonica.ae. The customer who completes and confirms the purchase order on this website (www.canonica.ae), accepts these general terms and conditions of sale of Canonica Restaurant & Catering LLC, a Limited Liability Company with Commercial License number 724428, whose registered address is Rasis Business Center, Office #59, 6th Floor, Dubai, United Arab Emirates.
1.2 No special condition or other conditions of the customer may prevail over these conditions, without the express agreement in writing of Canonica Restaurant & Catering LLC.
1.3 Canonica Restaurant & Catering LLC is the official distributor within United Arab Emirates of the products displayed within the online Website, www.canonica.ae. The online Website, www.canonica.ae is owned and operated by Canonica Restaurant & Catering LLC.
1.4 These General Terms and Conditions of Sale may be updated from time to time without notice.
1.5 Placing an order through our website will mean that the orderer will be deemed to have consented to the latest version of the General Terms and Conditions of sale posted on our Website.
1.6 If a change in law requires to change our General Terms and Conditions of sale after the order has been placed but before it has been fulfilled, the new law changes will apply to the order.
1.7 Customers under 18 years of age, are not able to lawfully place an order and process any payment what so ever on our Website www.canonica.ae.
1.8 Canonica.ae website is for your personal use. Commercial usage is not permitted. Each order for products is subject to acceptance by Canonica, which reserves the right to reject any order due to insufficient stock, incomplete customer information, or any other legal reason.
1.9 Access to our Website, www.canonica.ae is provided “as is” and on an “as available” basis. In case of alteration, suspension or closure of the Website, www.canonica.ae, without notice, Canonica Restaurant & Catering LLC will not be liable.
2. Placing orders and confirmation
2.1 The presentation of products on the online store does not constitute a contractual obligation. It is an invitation to place an order.
2.2 By confirming his order, the customer places a firm order for the products in his basket which binds him to these General Terms and Conditions of sale. The customer no longer has the possibility to change it.
2.3 The customer undertakes to correctly fill in all the necessary data concerning him such as his name, recipient's address, payment details. In the event of an error in the recipient's contact details, Canonica Restaurant & Catering LLC cannot be held liable for the impossibility to deliver to the recipient.
2.4 The Website may contain information regarding the availability of the products. Unfortunately, the inventory of products might change throughout a day. Each order of products is subject to acceptance by Canonica Restaurant & Catering LLC which reserves the right to reject any order due to insufficient stock, incomplete customer information or any other legal reason. In such circumstances Canonica Restaurant & Catering LLC will notify the Customer within 48 hours.
2.5 We cannot guarantee that an item stated to be available will actually be available right away, a product may be available when you place an Order but sold out by the time we process the Order. In such circumstances, Canonica Restaurant & Catering LLC will cancel the order, notify the customer and initiate a full refund within 48 hours.
3. Price and payments
3.1 The prices of the products are net and inclusive of VAT and are in Dirham from United Emirates (AED). Shipping costs (transport) are subject to additional charges. These vary according to the place of delivery, the weight and volume of the package.
3.2 The product prices that are indicated on the Website, www.canonica.ae on the day on which the customer places the order are binding.
3.3 The delivery and packaging costs are shown separately on the invoice. Ordered products are delivered at the customer’s expense.
3.2. The payment of products ordered online is done only by the following credit & debit cards: MASTERCARD, VISA, online via the Internet. The validation of the credit & debit card payment is immediate.
3.4 The ordered products will only be shipped after the payment has been received.
4. Delivery terms – Transport – deadlines
4.1 Delivery is available exclusively within the United Arab Emirates. Please note that we cannot deliver to P.O. Boxes, a physical street address is required.
4.2 The products are prepared and packaged by Canonica Restaurant & Catering LLC in closed, resistant packaging adapted to the contents and transport requirements.
4.3 Canonica Restaurant & Catering LLC undertakes to ship the products ordered by the customer as soon as possible using a high quality carrier.
4.4 No compensation may be claimed in the event of any delay in delivery. Canonica Restaurant & Catering LLC cannot be held responsible for any damage that may occur to products due to the opening of the package during its delivery, nor in the event of the recipient's absence at the time of delivery of the package, nor in case of incorrect delivery address, nor in the event of unforeseeable problems. In cases of this kind, the customer shall not be entitled to withdraw from the purchase agreement or to claim compensation for damages.
4.5 The delivery times indicated on the Website, www.canonica.ae are indicative. The customer is informed that longer delivery times during special occasions and holidays (e.g. Valentine's Day, Easter, Mother's Day and Christmas, etc…) are to be expected. Orders should be planned accordingly.
5. Products General Informations
5.1 None of the products offered on the Website, www.canonica.ae contains alcohol.
5.2 All of our products may contain allergens (milk, gluten, nuts such as : hazelnuts, almonds, etc.). They are made in the same environment as nuts so we cannot guarantee they are free from nut traces. The information on the packaging is authoritative. Please read it carefully before consumption. We cannot be held liable for allergic reactions to listed ingredients.
6. Reception of products – Complaints
6.1 Upon reception of the products, the customer must ensure that the delivery is in conformity with his order.
6.2 Any complaints in relation to quality or completeness must be sent immediately to Canonica Restaurant & Catering LLC in writing, or within a maximum of 12 hours after receipt of the package (chocolates@canonica.ae). After this period, no claim will be taken into account and the delivery of products shall be deemed to have been fully accepted.
6.3 . The claim must be justified, documented with description and photograph(s), detailed and mention the article(s) concerned with their respective batch numbers in order to facilitate its processing.
6.4 Canonica Restaurant & Catering LLC shall not be held liable for transport damage or any damage caused by improper storage of the products after acceptance by the customer or his/her agents/representatives.
7. Return & Exchange
7.1 After an unsuccessful delivery attempt by delivery services, the products are not returned to Canonica Restaurant & Catering LLC. In such an event, the customer must place a new order which will be fully charged to him.
7.2 Only fully documented submitted claims might be eligible for reshipment.
8. Data Protection
8.1 The data necessary for the delivery of the products is forwarded to the transportation company in charge of the delivery.
8.2 The Customer accepts to provide his personal requested data for payment processes.
8.3 Canonica Restaurant & Catering LLC may conduct order-related and other correspondence electronically, and also via unencrypted e-mails. The data is used for customer relations within the United Arab of Emirates or abroad.
8.4 The customer is expressly advised of the security risks beyond the control of Canonica Restaurant & Catering LLC connected with data transfer by e-mail, including the transfer of viruses, damage to and/or loss of data, and unauthorized third-party access.
8.5 Otherwise, stored data is not passed on to any third parties. Please refer to the Privacy Policy for further details.
9. Intellectual Property
9.1 The use of the Website, www.canonica.ae and its contents does not grant the customer any copyright, design, trademark or other intellectual property rights relating to the Content (graphics, photographs, recipes, including all image rights, sounds, music, video, logos, icons audio or text on this Website), including the software, HTML, plugins or other code contained in the Website. All such Content including third party trademarks, designs, and related intellectual property rights mentioned or displayed on this Website is typically protected by national and international intellectual property laws and treaties.
9.2 Any reproduction or redistribution of the content is prohibited and may result in civil and criminal penalties. Without limiting the foregoing, linking, commercially exploiting, copying and use of the above listed materials on any other server, location or support for publication, reproduction or distribution is expressly prohibited.
10. Force majeure
Canonica Restaurant & Catering LLC is not liable for non-performance of the contract for reasons beyond its control, such as strikes, terrorist acts, wars, natural disasters, problems affecting suppliers and transport. Each party shall be entitled to an additional reasonable period of time to perform depending on the circumstances.
11. Warranties
11.1 The minimum shelf life date is indicated on each package. Canonica Restaurant & Catering LLC guarantees the quality and freshness of its products subject to compliance with the storage instructions mentioned on the packaging and labelling.
11.2 We do not warrant that the Products will perfectly meet your subjective expectations, especially where such expectations exceed the explicit information provided on our Website or product packaging. Should you have any doubts regarding the features or suitability of a product, please contact our customer service department for personalized advice.
12. Applicable law / Severability / Amendments / Place of jurisdiction
12.1 These general terms and conditions of sale are governed exclusively by the federal law of the United Arab Emirates and the laws of the Emirate of Dubai.
12.2 If any part of these General Terms and Conditions of sale is declared void by a court of law, this does not affect the validity of the remaining provisions of these general terms and conditions of sale. They may be modified at any time by Canonica Restaurant & Catering LLC.
12.3 The courts of Dubai, United Arab Emirates have jurisdiction over any dispute or disagreement concerning these General Terms and Conditions of sale.
